Terms and Conditions

1. Definitions

In these regulations, the words in the left-hand column have the meaning attributed to them in the right-hand column.

Applicant: person nominated by a principal in accordance with regulation 2 below or person making a personal application in accordance with regulation 3 below.

Application form: the application form published by the Trust from time to time on its website.

Council: the Council of the Laurens Baudains Scholarship Trust Incorporated.

Nominee: person nominated in accordance with regulation 4 by the principal of any educational or training establishment in Jersey attended by the nominee at the time of the nomination.

Personal applicant: applicant who has not been nominated by a principal.

Principal: the principal of any educational or training establishment in Jersey.

Trust: the Laurens Baudains Scholarship Trust Incorporated.

Trust Fund: the assets of the Trust as defined in paragraph 2 of the Constitution of the Trust.

Website: the website maintained by the Trust as amended from time to time.

2. Nomination by a principal

2.1 A principal who wishes to nominate an applicant must –

2.1.1 apply the principles set out in regulation 5 below, and

2.1.2 be satisfied that the applicant satisfies the criteria set out in regulation 6 below.

2.2 The nomination must be accompanied by –

2.2.1 an application form completed by the nominee, and

2.2.2 such documents as are specified in the application form.

3. Personal application

3.1 A personal applicant must satisfy the criteria set out in regulation 6 below.

3.2 The application must be made in the application form.

3.3 The application must be accompanied by such documents as are specified in the application form.

4. Selection by the Council

4.1 In selecting an applicant to be educated and trained out of the Trust Fund the Council must –

4.1.1 apply the principles set out in Regulation 5 below.

4.1.2 be satisfied that the applicant satisfies the criteria set out in
regulation 6 below.

5. Principles

5.1 The Council will determine applications without regard to the age, race, gender, or religious or political beliefs of the applicant save insofar as it appears to the Council that such factors may affect the extent to which the applicant may or may not satisfy the criteria specified in 6.1.3 or 6.1.4 below.

6. Criteria

6.1 The applicant must satisfy the following criteria –

6.1.1 the applicant must have been educated in Jersey for a period of not less than five years or for a number of academic terms equivalent to five academic years.

6.1.2 the applicant must be a person who –

– is unable, and/or

– whose parents or guardians are unable

to afford further education or training for the applicant without suffering financial hardship.

6.1.3 the giving of financial assistance to the applicant by the Trust must be likely to be of future benefit to Jersey, as evidenced by the statement from the applicant.

6.1.4 the applicant must be a person who is likely to make good use of the further education or training, as evidenced by the statement from the applicant.

7. Terms and conditions

7.1 The Council shall not be required to give reasons for its decision.

7.2 The decision of the Council shall be final and without appeal.

7.3 An award may be withdrawn by the Council at any time if it becomes aware that the application in respect of which the award was made was false or misleading in a material particular.

8. Publication of regulations

8.1 These regulations, and any future amendments to these regulations, shall be published by the Trust on its website.
